The German Product Safety Act has been amended and entered into force

The German Product Safety Act (ProdSG), which is the legal basis for the GS mark (German safety certification mark), has been revised and will come into force on July 16, 2021.

One of the main changes in the new law: If the manufacturer is located outside the European Union (EU) or the European Free Trade Association (EFTA: Iceland, Norway, Switzerland, Liechtenstein), or cannot provide an address legally registered in the EU to accept a summons, the statutory The authorized representative shall submit the certificate application on behalf of the manufacturer.

The application process for the GS mark has been modified as follows:

Case 1

Manufacturer located in the EU/EFTA territory:

There are no changes to the current process;

Case 2

The manufacturer is not located in the EU/EFTA, but has an authorized representative in the EU/EFTA territory at the time of application: the authorized representative acts as the applicant, and the manufacturer acts as the certificate holder to sign the application at the same time. GS projects will be processed according to the current process;

Case 3

The manufacturer is not located in the EU/EFTA territory and does not have an authorized representative in the EU/EFTA territory at the time of application: The manufacturer can first apply for the safety certification mark, which will include all the requirements of the GS project. Once there is an authorized representative in the EU/EFTA territory, the GS certification application will be signed by the representative, and the GS certificate will be issued on the basis of the security certification project.
